Terms of Service for ReadingPro

Welcome to ReadingPro! These Terms of Service ("Terms") govern your use of the ReadingPro mobile application (the "Application" or "Service") provided by Fun Games Limited ("we," "us," or "our"). By downloading, accessing, or using our Application, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. Description of the Service

ReadingPro is an advanced reading and comprehension tool for English language learners. Our Service is designed to help you improve your reading skills, expand your vocabulary, and enhance your critical thinking within an authentic English context. Key features include:

• Intelligent Text Recognition: Use your device's camera (OCR) or import files to digitize and interact with printed English texts.
• Instant Dictionary Lookup: Tap on any word or phrase to access English-to-English definitions, usage examples, and audio pronunciations without leaving the reading interface.
• Sentence and Grammar Analysis: Deconstruct complex sentences to understand their grammatical structure and logic.
• Vocabulary Level Assessment: Automatically analyze and display the CEFR (A1-C2) level of words in a text to help you gauge its difficulty.
• Smart Flashcard System: Create and review flashcards from new vocabulary encountered during reading, using a spaced repetition system to enhance memory.
• Audiovisual Learning: (Where available) Engage with integrated audio and video content with synchronized subtitles, allowing for an immersive learning experience.
• Podcast Player: Browse, search, and listen to publicly available podcasts sourced via the Apple iTunes Podcast API. ReadingPro acts solely as a podcast player and does not host or own any podcast content.

2. Eligibility and Account Registration

Age Requirement: The Service is designed for users of all ages. We welcome learners at every stage of their English language journey. For children and minors, we recommend that parents or legal guardians supervise their use of the Application and review these Terms on their behalf.

Account Security: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Content Advisory for Parents and Guardians: While ReadingPro is designed to be accessible to users of all ages, the content available through our Service—including audiovisual materials (such as educational videos from sources like BBC Learning English, TED, TED-Ed, The Economist) and public domain books (such as classic literature from the Gutenberg Project)—may cover a wide range of topics and complexity levels. Some materials may discuss mature themes, complex social issues, current events, or advanced vocabulary that may not be suitable for young children without guidance.

We strongly encourage parents and guardians to:

• Review content selections before allowing children to use them
• Supervise children's use of the Audiovisual Learning feature
• Guide children in selecting age-appropriate reading materials
• Use the Service as an opportunity for family learning and discussion

3. Subscriptions, Fees, and Payment

ReadingPro operates on a freemium model. Certain features are available for free, while access to premium features requires a subscription.

• Premium Features: Advanced functionalities, such as unlimited OCR usage and access to the Collins Dictionary, are part of our subscription plan ("Subscription").
• Free Trial: We offer a one-time 3-day free trial for new users to experience the full benefits of a Subscription. Your Subscription will automatically begin and your payment method will be charged at the end of the trial period unless you cancel beforehand.
• Billing and Auto-Renewal: Subscriptions are managed through the Apple App Store or Google Play Store. Your Subscription will automatically renew at the end of each billing cycle (e.g., monthly or annually) unless you cancel it through your respective app store account settings at least 24 hours before the end of the current period.
• Refund Policy: All payments are handled by the Apple App Store or Google Play Store. As such, we do not offer refunds. Any refund requests must be directed to the platform where you made the purchase, subject to their terms and policies. No refunds will be provided for periods following the expiration of the free trial.

4. Intellectual Property Rights

All materials within the Service, including the software, design, text, graphics, images, and all other content (collectively, the "Service Content"), are the proprietary property of Fun Games Limited or our licensors. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial educational purposes.

You may not copy, modify, distribute, sell, or lease any part of our Service or Service Content, nor may you reverse engineer or attempt to extract the source code of the software.

5. User-Uploaded and Public Domain Content

Our Service allows you to learn from various content sources:

• User-Uploaded Content: You may import your own digital books or documents ("User Content") into the Application for personal study. You represent and warrant that you have the legal right to possess and use any User Content you upload. We do not claim ownership of your User Content, but you grant us a license to process it to provide the Service's features to you.
• Public Domain Content: The Service may provide access to materials from sources like the Gutenberg Project, which are in the public domain.

6. Audiovisual Learning and YouTube API Services

Our Audiovisual Learning feature is powered by the YouTube API Services. By using this feature, you acknowledge and agree to the following:

• Governing Terms: You agree to be bound by the YouTube Terms of Service. Your use of this feature is also subject to the Google Privacy Policy.
• Content Ownership: All video and audio content provided through this feature originates from YouTube and is the property of the respective content creators. We do not claim ownership or control over this content.
• Content Availability Disclaimer: We provide this feature as an educational tool. However, we do not guarantee the continuous availability, accuracy, or suitability of any specific video content. Videos may be removed, or their availability may be restricted by YouTube or the original creators at any time without notice. We reserve the right to change or remove video content within our Service accordingly.
• Geographic Restrictions: Please be aware that access to certain YouTube content may be restricted in your country or region due to local laws or platform policies. We are not responsible for any such restrictions.

7. Podcast and Apple iTunes Search API

Our Podcast feature allows you to search, browse, and listen to publicly available podcasts. This feature is powered by the Apple iTunes Search API. By using this feature, you acknowledge and agree to the following:

• Content Ownership: All podcast content, including audio, artwork, descriptions, and episode listings, is the property of the respective podcast creators and rights holders. We do not own or claim any rights to the podcast content. We act solely as a tool that provides access to publicly available podcasts.
• Content Availability Disclaimer: We do not guarantee the continuous availability, accuracy, or suitability of any specific podcast content. Podcasts may be removed, or their availability may be restricted by the original creators or distributors at any time without notice.
• Copyright and DMCA: If you are a content owner and believe that your podcast is being accessed in a way that infringes your rights, please contact us at service@ttyy.io.

8. Third-Party Service Providers

The Application utilizes services from third-party providers to function. By using our Service, you acknowledge and agree to the terms of these providers. These include, but are not limited to:

• Google Play Services
• Apple App Store
• Firebase
• OpenAI
• Google
• YouTube API Services

9. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy. Please review it carefully.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE SPECIFICALLY DISCLAIM ANY LIABILITY FOR THE AVAILABILITY, ACCURACY, OR LEGALITY OF THIRD-PARTY CONTENT, INCLUDING CONTENT ACCESSED VIA THE YOUTUBE API SERVICES OR THE APPLE ITUNES SEARCH API. ALL PODCAST CONTENT IS PROVIDED BY THIRD-PARTY CREATORS AND WE ASSUME NO RESPONSIBILITY FOR ITS CONTENT, QUALITY, OR AVAILABILITY.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms within the Application or by other means of communication. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Service provider is located, without regard to its conflict of law principles.

Any dispute arising from these Terms or the Service shall first be resolved through good faith negotiations between the parties. If a resolution cannot be reached within a reasonable time, the dispute shall be submitted to the competent courts in the jurisdiction where the Service provider is located.

14. General Provisions

• Language: These Terms were written in English. To the extent any translated version of these Terms conflicts with the English version, the English version controls.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
